1. 本サービスの概要

本利用規約（以下「本規約」といいます）は、Initial S株式会社（以下「Initial S」または「当社」といいます）が提供するmykura、くらちゃん、MeCloudデバイス、当社ウェブサイトおよび関連サービス（以下、総称して「本サービス」といいます）の利用に適用されます。本サービスを利用することにより、お客様は本規約に同意したものとみなされます。

MeCloudは、ご家庭でデータを安全に保存し、インテリジェントに管理できるパーソナルAIクラウドデバイスです。AIアシスタントのくらちゃんは、保存されたデータの整理、検索および活用を支援します。

2. 利用資格

本サービスを利用するには、次の条件を満たす必要があります。

• 13歳以上であること
• 本規約および当社のプライバシーポリシーに同意すること
• 適法な目的に限って本サービスを利用すること

3. アカウント

一部の機能を利用するには、アカウントの作成が必要です。お客様は次の事項について責任を負います。

• 正確かつ最新のアカウント情報を維持すること
• パスワードおよびアクセス認証情報を安全に管理すること
• お客様のアカウントで行われるすべての行為

アカウントが不正利用された疑いがある場合は、直ちにinfo@mykura.aiまでご連絡ください。

4. 禁止事項

お客様は、本サービスを次の目的または方法で利用してはなりません。

• 適用される法令または規制に違反すること
• 他者の知的財産権、プライバシーまたはその他の権利を侵害すること
• マルウェア、ウイルスまたはその他の有害なソフトウェアを配布すること
• 本サービスもしくはそのシステムへ不正にアクセスし、またはその運用を妨害すること
• 本サービスを第三者へ再販売または再配布すること
• 当社が明示的に許可した場合を除き、過度な自動アクセスを行うこと
• 当社または第三者を欺き、または詐取すること

5. 外部連携サービス

本サービスでは、OAuthを通じてGoogle、Microsoft、GitHub、Slack、Notion、Dropboxその他の第三者サービスと連携できます。これらの連携には、次の事項が適用されます。

• 第三者サービスの利用には、それぞれの利用規約およびプライバシーポリシーが適用されます。
• 第三者サービスとの連携は任意であり、MeCloudの設定からいつでも連携を解除できます。
• 外部連携サービスのデータがどのように利用および保存されるかについては、当社のプライバシーポリシーをご確認ください。
• 外部連携サービスの機能は、障害または第三者APIの変更によって利用できなくなる場合があります。

6. データの所有権

ファイル、写真、文書および外部連携サービスから取得したデータを含め、お客様がMeCloudに保存するすべてのデータは、お客様に帰属します。当社は、お客様のデータについて所有権を主張しません。

当社は、本サービスを提供するために必要な範囲でのみお客様のデータを処理します。詳細は、当社のプライバシーポリシーをご確認ください。

7. 知的財産権

本サービスに関連するすべてのソフトウェア、デザイン、商標およびコンテンツ（お客様のコンテンツを除きます）は、当社または当社のライセンサーに帰属します。

当社は、お客様に対し、個人的かつ非商用の目的で本サービスを利用するための、限定的、非独占的かつ譲渡不能なライセンスを付与します。

8. 免責事項

本サービスは、いかなる種類の保証もなく「現状有姿」で提供されます。当社は、次の事項を保証しません。

• 本サービスが中断またはエラーなく動作すること
• 本サービスがお客様の特定の要件を満たすこと
• 連携する第三者サービスが正確であり、または利用可能であること
• AIアシスタントの回答が正確または完全であること

重要なデータは定期的にバックアップすることを推奨します。

9. AIポリシー

本条は、くらちゃんを含む本サービスのAI機能の利用に適用されます。

9.1 AIの役割

くらちゃんは、大規模言語モデル（LLM）を利用したAIアシスタントです。ファイルの整理と検索、ウェブ検索、リマインダーの設定、スケジュール管理、情報整理などのタスクをサポートします。

9.2 AI出力の性質

AIの応答は確率的に生成されるものであり、常に正確であるとは限りません。

• 事実と異なる情報（ハルシネーション）を生成する場合があります。
• 法律、医療、財務その他の専門的なアドバイスの代替にはなりません。
• 重要な判断を行う際は、必ず情報を独自にご確認ください。
• AIの応答は参考情報としてご利用ください。

9.3 ツールの実行

AIは、お客様の指示に基づき、MeCloudデバイス上でファイル操作やコマンド実行などのツールを使用することがあります。これらの操作はお客様のデバイス上で実行され、AIが実行したツールの結果についてはお客様が責任を負います。

AIは安全性に配慮してツールを使用しますが、予期しない結果が生じる可能性があります。重要なファイルは定期的にバックアップすることを推奨します。

9.4 利用するAIモデル

本サービスでは、Anthropic社のClaudeモデルシリーズを使用しています。Kura AIの利用時は、Amazon Bedrockを通じてモデルにアクセスします。使用するモデルは、プランまたは技術的な改善により変更される場合があります。

9.5 AIが生成したコンテンツの責任

AIが生成したコンテンツの利用については、お客様が責任を負います。次の目的でのAIの利用は禁止されています。

• 違法な活動の支援または促進
• 有害、差別的または攻撃的なコンテンツの意図的な生成
• 他者を欺くための虚偽情報の作成
• 第三者の権利を侵害するコンテンツの生成

本項は、第4条（禁止事項）に定める事項に加えて適用されます。

9.6 サービスの制限

AIモデルには知識のカットオフ日があり、最新の情報を反映していない場合があります。ウェブ検索ツールによって補完できる場合がありますが、情報の完全性または正確性を保証するものではありません。

9.7 AI処理におけるデータの取扱い

AI機能の利用にあたってどの情報がどこで処理されるか、Kura AIとお客様自身のAIプロバイダーを設定した場合の違い、および会話データをAIモデルの学習に使用しないことについては、当社のプライバシーポリシー「AI処理とプロバイダーの選択」をご確認ください。

10. 責任の制限

適用法令で認められる最大限の範囲において、当社は、データの損失、事業の中断または逸失利益を含む、間接的、付随的、特別または結果的な損害について責任を負いません。

当社が負う累積責任の総額は、問題が発生した月にお客様が当社へ支払った金額を超えないものとします。

11. 利用の終了

お客様は、info@mykura.aiまでご連絡いただくことで、いつでもアカウントを解約できます。

お客様が本規約に違反した場合、または当社が必要と判断した場合、当社は事前の通知なくお客様のアカウントを停止または終了する権利を有します。

知的財産権、免責事項および責任の制限を含め、その性質上終了後も存続すべき条項は、引き続き効力を有します。

12. 準拠法および管轄裁判所

本規約は、日本法に準拠し、日本法に従って解釈されます。本規約に起因または関連する紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

13. 本規約の変更

当社は、本規約を随時変更することがあります。重要な変更については、メールまたはアプリ内通知でお知らせします。当該通知後も本サービスの利用を継続した場合、お客様は変更後の本規約に同意したものとみなされます。

1. Service Overview

These Terms of Service (“Terms”) govern your use of mykura, Kura-chan, a MeCloud device, our websites, and related services (collectively, the “Service”) provided by Initial S, Inc. (“Initial S,” “we,” “us,” or “our”). By using the Service, you agree to these Terms.

MeCloud is a personal AI cloud device that lets you securely store and intelligently manage your data at home. Kura-chan, the AI assistant, helps you organize, search, and make use of your stored data.

2. Eligibility

To use the Service, you must:

• be at least 13 years of age;
• agree to these Terms and our Privacy Policy; and
• use the Service only for lawful purposes.

3. Accounts

Some features require you to create an account. You are responsible for:

• maintaining accurate and up-to-date account information;
• keeping your password and access credentials secure; and
• all activity that occurs under your account.

If you suspect unauthorized use of your account, contact us immediately at info@mykura.ai.

4. Prohibited Uses

You agree not to use the Service to:

• violate any applicable laws or regulations;
• infringe the intellectual property, privacy, or rights of others;
• distribute malware, viruses, or other harmful software;
• gain unauthorized access to or interfere with the Service or its systems;
• resell or redistribute the Service to third parties;
• engage in excessive automated access, unless expressly permitted by us; or
• deceive or defraud us or any third party.

5. Connected Services

The Service allows you to connect third-party services such as Google, Microsoft, GitHub, Slack, Notion, Dropbox, and others via OAuth. The following applies:

• Your use of third-party services is governed by their respective terms of service and privacy policies;
• connecting third-party services is optional, and you may revoke a connection at any time from your MeCloud settings;
• our Privacy Policy explains how connected-service data is used and stored; and
• the availability of connected-service features may be affected by outages or changes to third-party APIs.

6. Data Ownership

All data you store in MeCloud—including files, photos, documents, and data retrieved from connected services—belongs to you. We make no claim of ownership over your data.

We process your data only to the extent necessary to provide the Service. For details, see our Privacy Policy.

7. Intellectual Property

All software, designs, trademarks, and content related to the Service (excluding your content) are owned by us or our licensors.

We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

8. Disclaimers

The Service is provided “as is” without warranties of any kind. We make no guarantees that:

• the Service will operate without interruption or errors;
• the Service will meet your specific requirements;
• connected third-party services will be accurate or available; or
• responses from the AI assistant will be accurate or complete.

We recommend keeping regular backups of important data.

9. AI Policy

This section applies to your use of the AI features of the Service, including Kura-chan.

9.1 Role of AI

Kura-chan is an AI assistant powered by large language models (LLMs). It supports tasks such as organizing and searching files, web search, setting reminders, schedule management, and information organization.

9.2 Nature of AI Outputs

AI responses are probabilistically generated and may not always be accurate.

• The AI may produce information that is factually incorrect (hallucinations).
• AI responses are not a substitute for professional legal, medical, financial, or other expert advice.
• Always verify information independently before making important decisions.
• Treat AI responses as reference information only.

9.3 Tool Execution

Based on your instructions, the AI may use tools to perform file operations, execute commands, and take similar actions on your MeCloud device. These operations run on your device, and you are responsible for the outcomes of tools executed by the AI.

While the AI uses tools with safety in mind, unexpected results may occur. We recommend regularly backing up important files.

9.4 AI Models Used

The Service uses Anthropic's Claude model family. When you use Kura AI, models are accessed through Amazon Bedrock. The specific model may change based on your plan or technical improvements.

9.5 Responsibility for AI-Generated Content

You are responsible for how you use AI-generated content. The following uses of AI are prohibited:

• assisting or promoting illegal activities;
• intentionally generating harmful, discriminatory, or abusive content;
• creating false information intended to deceive others; or
• generating content that infringes the rights of third parties.

This subsection applies in addition to the prohibited uses set out in Section 4.

9.6 Service Limitations

AI models have a knowledge cutoff date and may not reflect the most recent information. The web search tool may supplement this, but we do not guarantee the completeness or accuracy of the information.

9.7 Data Handling in AI Processing

For details on what information is processed and where when you use AI features, the difference between Kura AI and configuring your own AI provider, and our commitment not to use conversation data to train AI models, see “AI Processing and Provider Choice” in our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages, including data loss, business interruption, or lost profits.

Our total cumulative liability shall not exceed the amount you paid us in the month in which the issue arose.

11. Termination

You may cancel your account at any time by contacting info@mykura.ai.

We reserve the right to suspend or terminate your account without prior notice if you violate these Terms or if we determine it is necessary.

Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will remain in effect.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Japan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notification. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.
